Privacy Policy.
Your privacy matters to us. This policy explains what personal information we collect, how we use and protect it, and the rights you have over your data.
Halal Car Finance — Privacy Policy
We respect and value the privacy of everyone who visits our website and everyone who applies for car finance through us. This policy explains what personal information we collect, how we use and protect it, who we share it with, and the rights you have over your information. Please read it carefully so that you understand how we look after your information. Your use of our website and our service means that you have read and understood this policy.
1. Who we are
CarFinanced Ltd t/a Halal Car Finance is a company registered in England under company number 13109658, with its registered office at The Charter Building, Charter Place, Uxbridge, UB8 1JG. In this policy, “we”, “us” and “our” mean CarFinanced Ltd t/a Halal Car Finance.
We are a credit broker, not a lender. We help you find and apply for Sharia-compliant car finance by introducing you to finance providers from our panel.
We are the data controller responsible for the personal information we collect from you through our website and our broking service. This means we decide how and why that information is used. We are registered with the Information Commissioner’s Office under registration number ZA847951, and we are authorised and regulated by the Financial Conduct Authority under reference number 1014460.
When we introduce you to a finance provider, that finance provider becomes a separate controller of the information it holds about you and handles it under its own privacy policy. We explain this further below.
If you have any questions about this policy or about how we use your information, you can contact us using the details in the final section.
2. What this policy covers
This policy applies to the personal information we collect through our website, when you contact us, and when you apply for finance through us. It also explains the rights you have under data protection law and how to exercise them.
3. The information we collect
We collect and use the following kinds of personal information.
Information you give us. This includes your name, date of birth, contact details such as your address, email address and telephone number, your employment and income details, details of the vehicle you are interested in, and any other information you provide when you apply, contact us, or use our service.
Information we collect when you use our website. This includes your device and browser information, your internet protocol address, and information about how you use our website, which we collect through cookies and similar technologies as explained in our Cookie Policy.
Information we receive from other organisations. To assess and progress an application and to prevent fraud, we may receive information about you from credit reference agencies, fraud prevention agencies, and the finance providers we introduce you to. We may also receive information from partners who help us provide our service, and from publicly available sources.
4. How we use your information
We use your personal information to provide our broking service, which includes assessing your enquiry, identifying suitable finance, introducing you to finance providers from our panel, and helping you apply for finance. We use it to verify your identity, to help carry out credit and affordability checks, and to prevent and detect fraud and money laundering.
We also use it to respond to your enquiries and provide customer support, to operate, improve and secure our website and our service, to meet our legal and regulatory obligations, and, where you have not asked us to stop, to tell you about products and services that may interest you.
5. The legal bases we rely on
Data protection law requires us to have a legal basis for using your personal information. Depending on the situation, we rely on the following.
Steps taken at your request before entering into a contract, and performance of our contract with you, where we use your information to provide our broking service and to introduce you to finance providers.
Compliance with a legal obligation, where we need to use your information to meet our obligations under financial regulation, anti fraud and anti money laundering rules, and other laws that apply to us.
Our legitimate interests, where we use your information to run and improve our business, keep our service secure, and prevent fraud, provided your interests and rights do not override those interests.
Your consent, where we ask for it, for example for certain marketing messages and for some cookies. Where we rely on consent, you can withdraw it at any time.
6. Special category information
We do not normally collect special category information, which is information such as details about health, religion or beliefs. Where we do need to use such information, for example to support you if you are in vulnerable circumstances, we will only do so where we are permitted to under data protection law and, where required, with your consent.
7. Credit reference and fraud prevention agencies
To assess and progress your application, we and the finance providers we work with may make searches with credit reference agencies and share information with them. They give us information about you, and a search and the finance may be recorded on your credit file. An initial eligibility check uses a soft search, which does not affect your credit score. A full search, which may be recorded and may be seen by other organisations, is only carried out if you choose to proceed.
To prevent fraud and money laundering, we and the finance providers may check your details with fraud prevention agencies. If we or a fraud prevention agency decides that there is a risk of fraud, finance may be refused. Records of any fraud may be kept by those agencies and may affect your ability to obtain finance or other services in the future.
8. Automated decisions
Part of assessing an application may involve automated processing, including credit scoring, carried out by us or by the finance provider to help make decisions quickly and consistently. Where a decision that affects you is based solely on automated processing, you have the right to ask for a person to review it, to express your point of view, and to challenge the decision. You can do this using the contact details at the end of this policy, or with the finance provider where the decision is theirs.
9. Marketing and your choices
Where we are permitted to, we may contact you about products and services that may interest you, by email, telephone, post or text message. You can ask us to stop sending you marketing at any time, by contacting us or by using the unsubscribe option in our messages. Asking us to stop marketing will not affect the information we send you about your application.
10. Who we share your information with
We do not sell your personal information. We share it only where it is needed to provide our service, to meet our legal and regulatory obligations, or as described in this policy. We may share your information with the following.
Finance providers on our panel, so that they can assess your application, provide a quote, and arrange your finance. When you are introduced to a finance provider, they use your information as a separate controller and under their own privacy policy, and we recommend you read it.
Service providers who help us run our business and provide our service, such as technology, identity verification and customer support providers, who act on our instructions.
Credit reference agencies and fraud prevention agencies, as explained above.
Regulators, law enforcement and other authorities, where we are required or permitted to share information by law or regulation.
Professional advisers such as lawyers, accountants and auditors, and any organisation to which we may transfer our business or rights in the future.
Where we share your information, we only share what is necessary, and we require others who act on our instructions to protect it and to use it only for the purposes we allow.
11. Sending information outside the UK
We aim to keep your information within the United Kingdom. Where any of our providers process information outside the United Kingdom, we make sure that appropriate safeguards are in place so that your information is protected to a standard consistent with UK data protection law.
12. How long we keep your information
We keep your personal information for as long as we need it for the purposes set out in this policy, and to meet our legal and regulatory obligations. For records relating to finance, this is usually at least six years after your relationship with us ends. When we no longer need your information, we securely delete or anonymise it.
13. How we keep your information secure
We use appropriate technical and organisational measures to protect your personal information against loss, misuse, unauthorised access, and disclosure. We limit access to your information to those who need it, and we keep our security measures under review. While no method of transmission over the internet is completely secure, we work to protect your information at all times.
14. Your rights
Under data protection law, you have the following rights over your personal information. You have the right to be told how your information is used and to be given a copy of the information we hold about you. You have the right to have inaccurate information corrected and, in some cases, to have your information deleted. You have the right to ask us to restrict or to stop using your information, the right to object to certain uses, and the right, in some cases, to receive your information in a portable format. Where we rely on your consent, you have the right to withdraw it.
To exercise any of these rights, please contact us using the details below. We will respond within the time allowed by law. You will not usually have to pay a fee.
15. Cookies
Our website uses cookies and similar technologies to help it work properly, to keep it secure, and to understand how it is used. Our Cookie Policy explains what we use and how you can manage your preferences.
16. Other websites
Our website may contain links to other websites that we do not control, including those of finance providers. This policy applies only to our website, so we encourage you to read the privacy policy of any other website you visit.
17. Changes to this policy
We may update this policy from time to time. Any changes take effect when the updated version is posted on our website, and the date at the top shows when it was last updated. Please check this page from time to time so that you are aware of any changes.
